TERMS OF USE

These Wellness Technology Map Locator Terms of Use ("Map Locator Terms") are an agreement between any person who accesses or uses the Wellness Technology Map Locator or QEWB Session Request functionality ("User") and Void Space Technologies, LLC ("VST"). They govern access to location information for independent QEWB Business Owners, associated map data and software, and the submission of requests for Quantum Energy Wellness Bed ("QEWB") sessions (collectively, the "Service").

For purposes of these Map Locator Terms:

Guest - the person intended to receive the QEWB session.

Submitter - the person completing a QEWB Session Request. The Submitter may be the Guest, a VST Team Member, an Affiliate participating in the VST Partner Program, or a QEWB Business Owner acting on the Guest’s behalf.

QEWB Business Owner - an independent business owner who owns or operates a QEWB and makes QEWB sessions available to Guests. A QEWB Business Owner may also participate in the VST Partner Program as an Affiliate.

VST Partner Program Affiliate - a person or entity participating in the VST Partner Program and subject to the applicable Partner Program terms (also referred to in these Map Locator Terms as a "VST Affiliate").

Referrer - the person or source identified as having referred the Guest. A Guest may also have no Referrer.

Session Request - a request submitted through VST asking a selected QEWB Business Owner to contact the Guest regarding a QEWB session. A Session Request is not a confirmed appointment.

These Map Locator Terms supplement VST’s Terms of Service and Privacy Policy, which are incorporated by reference. VST Partner Program terms may separately apply to an Affiliate participating in the VST Partner Program. If terms conflict, these Map Locator Terms control for Service-specific matters, the applicable separate policy controls for its subject matter, and the VST Terms of Service control all other matters.

By accessing or using the Service, or by submitting a Session Request, the User agrees to these Map Locator Terms. If the User does not agree, the User should not use the Service or submit a Session Request.

1. THE MAP LOCATOR SERVICE

1.1 Map Locator. The Service provides access to QEWB Business Owner location and business information, which may include business name, address, telephone number, email address, map information, and other related details ("Map Data"). The Map Locator is intended to help Users locate a QEWB Business Owner and request a QEWB session.

1.2 QEWB Session Requests. A Session Request may be submitted by the Guest or by an authorized Submitter on the Guest’s behalf. Submission of a Session Request does not confirm an appointment. The selected QEWB Business Owner will contact the Guest to confirm availability, pricing, and appointment details. The QEWB Business Owner is not required to accept a Session Request.

1.3 Independent Session Arrangements. QEWB Business Owners independently determine their session pricing, availability, scheduling, payment methods, cancellation terms, premises, and other session-specific arrangements. VST does not set or collect session fees unless VST expressly states otherwise for a particular offering.

1.4 Availability and Responsible Use. The Service is available only where VST makes it available. Map Data, availability, and business information may change. Users should confirm current details directly with the selected QEWB Business Owner and use reasonable judgment when visiting a location or receiving a QEWB session.

2. USE OF THE MAP LOCATOR SERVICE

2.1 Map Service Software. The Service includes Map Data, forms, and software used in connection with the Service. The VST Terms of Service apply to the User’s access to and use of the Site and related software.

2.2 Third-Party Services. VST may use third-party providers for mapping, hosting, forms, customer relationship management, analytics, communications, or other functionality supporting the Service. Those providers may have their own terms and privacy practices that apply to their services.

2.3 Restrictions. Users may use the Service only for its intended purposes. Users may not copy, scrape, modify, reverse engineer, misuse, or create derivative works from Map Data or Service software except as permitted by law, nor use business or Guest information obtained through the Service for unauthorized solicitation, harassment, fraud, or other unlawful or improper purposes.

3. INFORMATION, PRIVACY & AUTHORIZATION

3.1 Information Provided to VST. VST may receive information submitted through or generated by the Service, including Guest and Submitter contact information, preferred QEWB location, Submitter role, referral source, Session Request details, device and usage information, and other information reasonably necessary to operate, secure, administer, and improve the Service.

3.2 Privacy. Personal information collected through the Service is handled in accordance with the VST Privacy Policy: https://voidspacetech.org/policies/privacy-policy. VST may share information from a Session Request with the selected QEWB Business Owner as reasonably necessary to respond to and coordinate the requested session.

3.3 Requests Submitted on Behalf of a Guest. If a Submitter completes a Session Request on behalf of a Guest, the Submitter represents that the Guest authorized the Submitter to provide the Guest’s information to VST and the selected QEWB Business Owner and authorized VST and the selected QEWB Business Owner to contact the Guest by the contact methods authorized in connection with the request.

3.4 Communications. VST and the selected QEWB Business Owner may contact the Guest as reasonably necessary to respond to and coordinate the Session Request. Marketing communications are separate and are sent only where the Guest has separately consented or where otherwise permitted by applicable law.

3.5 Accuracy and Sensitive Information. Users agree to provide information that is accurate to the best of their knowledge. Users should provide only information reasonably necessary for the Session Request and should not submit emergency medical information through the Service.

4. COMPENSATION & FAIR PLAY

4.1 QEWB Business Owner is an Independent Business Owner who markets and makes available QEWB sessions to Users of the Map Locator marketplace. QEWB Business Owner determines and sets their own prices for QEWB sessions and operates their business independent of VST’s control or influence. A QEWB Business Owner may also be a VST Affiliate.

4.2 Guest who visits a QEWB Business Owner for the purpose of having a QEWB Session agrees to pay the going rate to the QEWB Business Owner for their QEWB Session.

4.3 QEWB Business Owner agrees to perform the QEWB Session in a safe, respectful, courteous, professional manner in accordance with highest industry standards. They agree to perform the QEWB Session and provide the deliverables in compliance with and shall not violate any applicable laws and standards.

4.4 QEWB Business Owner further represents and warrants that (a) it has full power and authority to perform its obligations under this Agreement without the consent of any other person, and to own its property and the authority to carry on its business; (b) the execution, delivery and performance of this Agreement have been duly authorized by QEWB Business Owner and this Agreement constitutes a valid and binding agreement of QEWB Business Owner, enforceable against QEWB Business Owner in accordance with its terms; (c) QEWB Business Owner is not under any obligation of a contractual or other nature to any person which is inconsistent or in conflict with this Agreement or which would prevent, limit or impair in any way the performance by QEWB Business Owner of its obligations under this Agreement or prevent or impair Guest from realizing the full, intended benefits of the Services; (d) neither the performance of the Services by QEWB Business Owner nor the provision to and use by Guest of deliverables, or the exercise of Guest’s rights under this Agreement, will in any way constitute an infringement, misappropriation or other violation of any intellectual property rights or other rights of any third party.

4.5 For all Referred Guests, QEWB Business Owner agrees to provide the standard performance and duration expected of a typical paid QEWB session and that any additional representation outside of the standard is voluntary and is not to be construed as a right or an entitlement to earn a commission.

4.6 QEWB Business Owner agrees that providing additional sessions to a Referred Guest is also voluntary and is not to be construed as an enhanced right or a further entitlement to earn a commission.

4.7 VST agrees to pay a QEWB Business Owner who is also a marketer (a VST Affiliate) a Celebration Bonus of US $100 for each qualifying QEWB Session Customer who has settled a QEWB purchase through the QEWB Business Owner’s sales representation. No action, other than using the Map Locator and QEWB Session Request process, is required of the QEWB Business Owner to receive the bonus. The bonus is paid monthly on the 15th of the month following the month when the customer made full payment for the QEWB. If this date falls on a weekend or a public holiday, the payment will occur on the next business day. Payments will be made via ACH or PayPal, as provided by the QEWB Business Owner.

4.8 VST agrees to pay a QEWB Business Owner who is not a marketer (i.e., is not a VST Affiliate) a Thank You Bonus of US $100 for each qualifying QEWB Session Customer who has settled a QEWB purchase through a marketer’s (VST Affiliate or VST Team Member) sales representation. No action, other than using the Map Locator and QEWB Session Request process, is required of the QEWB Business Owner to receive the bonus. The bonus is paid monthly on the 15th of the month following the month when the customer made full payment for the QEWB. If this date falls on a weekend or a public holiday, the payment will occur on the next business day. Payments will be made via ACH or PayPal, as provided by the QEWB Business Owner.

4.9 VST agrees to grant a QEWB Session Credit of US $100 towards the purchase of a QEWB to a qualifying QEWB Session Customer who has decided to purchase a QEWB and has communicated this purchase decision to their originating point of sales representation: the VST Affiliate, the QEWB Business Owner, or the VST Team Member. To receive this credit, the QEWB Session Customer will be required to submit to VST a Tax Receipt obtained from the QEWB Business Owner who provided the QEWB Session. The receipt should be submitted at the time of invoicing and should show the name and address of the QEWB Business Owner, the date the service was performed, the name of the Guest served, the purchased item (QEWB Session), and the amount that was paid.

4.10 A qualifying QEWB Session Customer is a Referred Guest or an Announced Guest who has received and paid for a QEWB Session with the QEWB Business Owner who had scheduled and performed the QEWB Session. A Referred Guest is a Guest who was referred to a QEWB Business Owner for a QEWB Session through VST. An Announced Guest is a Guest who went directly to a QEWB Business Owner for a QEWB Session and whose session request was submitted or recorded through the Map Locator or QEWB Session Request process.

4.11 User agrees that VST’s financial obligations are limited to the parameters set forth in this Agreement. User agrees that the system, the structure and the Agreement support fair play and protect the financial interests of all Users.

5. GENERAL

5.1 Changes and Amendments. VST reserves the right to change, suspend or discontinue the Service, or any part of it, at any time without notice. VST may amend the Agreement at its sole discretion by posting the revised terms. Users’ continued use of the Service after any amendment evidences their agreement to be bound by it.

5.2 Suspension and Termination. User agrees that User’s rights under the Agreement will automatically terminate without notice if User fails to comply with the terms of the Agreement. VST’s failure to enforce User’s strict compliance with the Agreement will not constitute a waiver of any of our rights. VST may terminate the Agreement or restrict, suspend or terminate User’s use of the Service at its discretion at any time without notice.

5.3 Disputes/Binding Arbitration. Any dispute or claim arising from or relating to the Agreement or the Service is subject to the binding arbitration, governing law, disclaimer of warranties, limitation of liability and all other terms in the voidspacetech.org Terms of Service.

5.4 Limitations of Liability. Without limiting the disclaimer of warranties and limitation of liability in the voidspacetech.org Terms of Service, in no event will VST or VST’s licensors' total liability to User for all damages (other than as may be required by applicable law in cases involving personal injury) arising out of or related to User’s use or inability to use the Service exceed the amount of fifty dollars ($50.00). These limitations will apply to User even if the remedies fail of their essential purpose.
